OSHA Job Site Toilet Rules for Kentucky Contractors

Kentucky job sites follow OSHA 29 CFR 1926.51 for toilets. A crew of 20 or fewer needs at least 1 toilet; bigger crews need 1 seat and 1 urinal per 40 workers. Kentucky runs its own state OSHA plan, which adopts the federal construction standard. Here is what that means on a real site.

What does OSHA Table D-1 require?

OSHA Table D-1 requires 1 toilet for 20 or fewer workers, 1 toilet seat and 1 urinal per 40 workers for 20 to 199, and 1 seat and 1 urinal per 50 workers for 200 or more. A standard porta potty has a seat and a urinal, so 1 unit counts as both. Read the official 1926.51 text.

Is the OSHA minimum enough?

The OSHA minimum is a floor, not a comfort level. A single unit serving 20 workers on a 40-hour week fills well before a weekly service. We recommend 1 unit per 10 workers with weekly service, or 1 per 20 with twice-weekly service. Fewer trips off site also means more work time.

Do Kentucky job sites need hand washing?

Kentucky job sites need washing facilities where crews apply paints, coatings, herbicides or other harmful materials, under OSHA 1926.51(f). Most general contractors place 1 hand washing station per site anyway. Keep the station near the toilet and the break area.

What should a contractor keep on file?

A contractor should keep the rental agreement, unit count and the dated service record for each site. Every unit we place carries a service tag dated at each weekly visit. Kentucky's Cabinet for Health and Family Services licenses portable toilet servicing under 902 KAR 10:170, which also governs where the waste goes.

Questions people ask before they book

Does OSHA require separate units for men and women?

OSHA requires separate toilet facilities for each sex only where toilet rooms hold more than one person. Single-user lockable units like porta potties can be shared by men and women. Each unit has a seat and a urinal. Use 1 unit per 10 workers for a comfortable count.

How far can the toilet be from the work?

OSHA 1926.51 sets no exact toilet distance for construction, but units must be readily available. On spread-out sites, place units so no one walks more than a few minutes. Large sites often need several clusters. Each cluster needs a truck path for service.

Do roofing crews of 3 need a unit?

A roofing crew of 3 needs toilet access, like every construction crew. If no house bathroom is available to the crew, plan on 1 unit. A job site unit starts at $185 per 28-day cycle. Jobs of 1 to 3 days can use event pricing instead.
